Welcome to MAGIKA Prints (“we,” “us,” “our,” or “the Company”). These Terms and Conditions (“Terms”) govern your access to and use of our print-on-demand services, website, and all related services (collectively, the “Services”).

By placing an order, accessing our website, or using our Services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and MAGIKA Prints. Please read them carefully before placing an order.


2. Services Overview

2.1 What We Offer

We provide custom print-on-demand services for t-shirts and apparel, including but not limited to:

  • Custom t-shirt printing
  • Corporate uniforms and branded apparel
  • Event merchandise
  • Personalized gifts
  • Bulk and wholesale printing
  • Design consultation services (optional)

2.2 Service Availability

Our Services are available to customers throughout the Philippines. We reserve the right to refuse service or cancel orders in our sole discretion for any reason, including but not limited to:

  • Violation of these Terms
  • Suspicious or fraudulent activity
  • Prohibited content in designs
  • Technical limitations
  • Operational constraints

3. Eligibility

3.1 Age Requirement

You must be at least 18 years of age to use our Services. If you are under 18, you may only use our Services with the involvement and consent of a parent or legal guardian.

3.2 Capacity to Contract

By using our Services, you represent and warrant that:

  • You have the legal capacity to enter into binding contracts
  • You are not prohibited from using our Services under Philippine law
  • All information you provide is accurate and complete

3.3 Business Customers

If you are ordering on behalf of a company or organization:

  • You represent that you have authority to bind that entity to these Terms
  • The entity agrees to be responsible for your actions and any breaches of these Terms

4. Ordering Process

4.1 Order Placement

To place an order:

  1. Select your product (t-shirt type, size, color, quantity)
  2. Upload your design or request design services
  3. Review and approve the digital proof (if provided)
  4. Provide accurate delivery and billing information
  5. Complete payment
  6. Receive order confirmation via email

4.2 Order Confirmation

An order confirmation email does not constitute our acceptance of your order. We reserve the right to accept or decline any order for any reason. Acceptance occurs when we begin production or send you a production confirmation.

4.3 Order Modifications

Once an order enters production, it cannot be modified or canceled. If you need to make changes:

  • Contact us immediately (within 2 hours of order placement)
  • Changes are subject to availability and may incur additional fees
  • We cannot guarantee that modifications can be accommodated

4.4 Bulk and Corporate Orders

Orders exceeding 100 pieces may require:

  • Written quotation and acceptance
  • Advance deposit (typically 50%)
  • Extended production timelines
  • Separate agreement or purchase order

For PhilGEPS-accredited government orders, additional documentation and compliance requirements apply.


5. Design Requirements and Intellectual Property

5.1 Customer Responsibilities

When submitting designs, you are responsible for:

  • Providing high-resolution files (minimum 300 DPI)
  • Ensuring files are in accepted formats (PNG, JPEG, PDF, AI)
  • Verifying design accuracy before approval
  • Obtaining all necessary rights and permissions

5.2 Design Ownership and Rights

You represent and warrant that:

  • You own all rights to submitted designs, or have proper authorization to use them
  • Your designs do not infringe on any third-party intellectual property rights
  • Your designs do not violate any trademark, copyright, or other proprietary rights
  • You have obtained necessary licenses for any third-party content (logos, images, fonts)

5.3 Prohibited Content

We reserve the right to refuse printing designs that contain:

  • Copyrighted material without authorization (brand logos, cartoon characters, sports team logos, etc.)
  • Trademarked content without proper licensing
  • Offensive, obscene, or vulgar content
  • Hate speech or discriminatory imagery
  • Illegal or harmful content
  • Content that violates Philippine laws or public morals
  • Defamatory or libelous material
  • Political propaganda (without proper permits)

5.4 Indemnification for Design Issues

You agree to indemnify, defend, and hold harmless [Your Company Name] from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Copyright or trademark infringement related to your designs
  • Unauthorized use of third-party intellectual property
  • Violation of any person’s rights of privacy or publicity
  • Any content you provide for printing

5.5 Our Design Services

If we provide design services:

  • Initial design concepts remain our property until full payment
  • Upon payment, you receive rights to use the final approved design for printing
  • We retain the right to showcase the design in our portfolio unless otherwise agreed
  • Design revisions are limited (typically 2-3 rounds)

6. Pricing and Payment

6.1 Pricing

All prices are:

  • Listed in Philippine Pesos (PHP)
  • Subject to change without notice
  • Exclusive of shipping fees unless stated otherwise
  • Final upon order confirmation

Bulk discounts are available for large orders. Contact us for quotations.

6.2 Payment Methods

We accept:

  • Bank transfer / deposit
  • GCash
  • PayMaya
  • Credit/Debit cards (via secure payment gateway)
  • Cash on Delivery (COD) – select locations only
  • Company check (for corporate accounts with credit terms)

6.3 Payment Terms

Individual/Retail Orders:

  • Full payment required before production begins
  • Payment must be completed within 24 hours of order placement
  • Unpaid orders will be automatically canceled after 24 hours

Corporate/Bulk Orders:

  • 50% deposit required to start production
  • Balance due before shipping
  • Credit terms available for established corporate clients (upon approval)

6.4 Payment Confirmation

After payment:

  • Email us proof of payment (screenshot or receipt)
  • Include your order number in the reference
  • Allow 1-2 hours for payment verification during business hours
  • Production begins after payment confirmation

6.5 Failed or Declined Payments

If payment fails or is declined:

  • Your order will be placed on hold
  • We will contact you to resolve the issue
  • The order may be canceled if payment is not received within 24 hours

6.6 Taxes

All applicable taxes (VAT, local taxes) are included in the final price unless stated otherwise. For corporate orders requiring official receipts or invoices with VAT, please inform us at the time of ordering.


7. Production and Quality Standards

7.1 Production Timeline

Standard production time: 3-5 business days after:

  • Payment confirmation
  • Design approval
  • All requirements are complete

Rush orders available with additional fees (24-48 hours production).

7.2 Design Proof Approval

For custom orders:

  • We may provide a digital proof for your approval
  • You must approve the proof before production begins
  • Once approved, changes cannot be made
  • If no feedback is received within 48 hours, we will proceed with production

Important: Carefully review proofs for accuracy. We are not responsible for errors in approved designs.

7.3 Color Accuracy

While we strive for color accuracy:

  • Colors may vary slightly from digital screens to printed products
  • Monitor calibration and settings affect color perception
  • Fabric color and type influence final appearance
  • Minor color variations (within 10%) are considered acceptable

7.4 Quality Control

Every order undergoes quality inspection before shipping. We check for:

  • Print quality and alignment
  • Fabric defects
  • Size accuracy
  • Overall product integrity

7.5 Acceptable Tolerances

Due to the nature of custom printing:

  • Slight variations in print placement (±1 cm) are normal
  • Minor color variations are acceptable
  • Small imperfections in fabric or stitching may occur
  • These do not constitute defects unless they significantly affect the product

8. Shipping and Delivery

8.1 Delivery Coverage

We deliver nationwide throughout the Philippines. Delivery times vary by location (see Shipping Policy for details).

8.2 Shipping Fees

Shipping costs are calculated based on:

  • Delivery destination
  • Order weight and size
  • Chosen courier service
  • Delivery speed (standard or express)

8.3 Delivery Address

You are responsible for providing:

  • Accurate and complete delivery address
  • Correct contact phone number
  • Clear delivery instructions if needed

We are not responsible for delays or non-delivery due to incorrect address information.

8.4 Delivery Attempts

Our courier partners typically make 1-2 delivery attempts. If delivery fails:

  • Courier will contact you to arrange re-delivery
  • Additional delivery fees may apply
  • After 3 failed attempts, the order may be returned to us

8.5 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the shipping carrier. We are not responsible for lost or stolen packages after successful delivery confirmation.

8.6 Inspection Upon Delivery

You must inspect orders immediately upon receipt. Report any issues within 24 hours of delivery for fastest resolution.


9. Returns, Exchanges, and Refunds

9.1 Return Policy Overview

Due to the custom nature of our products, returns are generally not accepted except for:

  • Manufacturing defects
  • Printing errors (our fault)
  • Wrong items shipped
  • Damaged products

9.2 Non-Returnable Items

We cannot accept returns for:

  • Change of mind
  • Customer design errors
  • Approved designs that don’t meet expectations
  • Incorrect size ordered by customer
  • Normal wear and tear
  • Items that have been worn or washed

9.3 Return Timeframe

Claims must be submitted within 7 days of delivery with:

  • Order number
  • Photos of the issue
  • Detailed description of the problem

9.4 Refund Processing

Approved refunds will be processed within 7-10 business days via:

  • Original payment method
  • Bank transfer
  • Store credit (if preferred)

Refunds exclude original shipping fees unless the error was ours.

9.5 Exchanges

For approved exchanges:

  • We will reprint the correct items at no charge
  • Original defective items must be returned
  • Shipping fees for exchanges are covered by us (if our error)

10. Warranties and Disclaimers

10.1 Limited Warranty

We warrant that our products:

  • Are free from manufacturing defects
  • Match the approved design specifications
  • Are of merchantable quality

This warranty is valid for 30 days from delivery date.

10.2 Print Durability

While we use high-quality printing methods:

  • Proper care and washing are essential for longevity
  • Prints may fade over time with repeated washing
  • Follow care instructions provided with your order
  • We do not warrant against normal wear and fade

10.3 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS

10.4 No Guarantee of Results

We do not guarantee that:

  • Services will be uninterrupted or error-free
  • Defects will always be corrected
  • Our website or servers are virus-free
  • Results will meet your specific requirements

11. Limitation of Liability

11.1 Maximum Liability

TO THE FULLEST EXTENT PERMITTED BY PHILIPPINE LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

11.2 Excluded Damages

WE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOST PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
  • LOSS OF DATA OR GOODWILL
  • SERVICE INTERRUPTIONS
  • COST OF SUBSTITUTE PRODUCTS OR SERVICES

This applies even if we have been advised of the possibility of such damages.

11.3 Essential Purpose

These limitations apply regardless of:

  • The legal theory (contract, tort, negligence, strict liability, or otherwise)
  • Whether the claim is based on breach of warranty or failure of essential purpose

11.4 Philippine Law

Some jurisdictions do not allow limitations on implied warranties or exclusion of consequential damages. In such cases, the above limitations may not apply to you, and you may have additional rights under Philippine consumer protection laws.


12. Indemnification

You agree to indemnify, defend, and hold harmless [Your Company Name], its officers, directors, employees, agents, suppliers, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

  • Software, code, and functionality
  • Trademarks and service marks
  • Template designs and catalogs
  • Business processes and methods

We grant you a limited, non-exclusive, non-transferable, revocable license to:

You may opt out of marketing communications but cannot opt out of essential service-related messages.

During force majeure events:

  • Our obligations are suspended for the duration
  • We will make reasonable efforts to resume services
  • You may cancel your order for a full refund if delay exceeds 30 days

19. PhilGEPS and Government Procurement

19.1 PhilGEPS Accreditation

As a PhilGEPS-accredited supplier, we comply with all requirements under:

  • Republic Act No. 9184 (Government Procurement Reform Act)
  • Its Revised Implementing Rules and Regulations
  • Relevant government procurement policies

19.2 Government Orders

For orders from government agencies:

  • Purchase orders or contracts must be provided
  • Payment terms follow government procurement procedures
  • Official receipts and documentation will be provided
  • Compliance with COA audit requirements
  • Additional terms may apply per agency requirements

19.3 Documentation

Government clients will receive:

  • Official receipts
  • Delivery receipts
  • PhilGEPS certification
  • VAT-compliant invoices
  • Other required documentation
